Gary, IN:  Indiana State Police investigation identifies an intoxicated semi driver as having multiple violations as well as possessing alcohol in a commercial motor vehicle; the driver was issued a Federal out of Service Order.

On February 5, 2013, ISP responded to a request for assistance from the Gary Police Department. The driver of a semi tractor trailer, Nebyou Brook, with a California commercial driver’s license, had driven off the roadway, across a parking lot and over concrete parking blocks. Indiana State Police Commercial Vehicle Enforcement Division (CVED) Sergeant Wanda Clay responded to the scene at 45th Avenue and Delaware Street, Gary, Indiana.

Gary Police Department conducted a DUI investigation which found Brook to have a blood alcohol content of .18 percent.

Clay conducted the driver and vehicle inspection, and found several log book violations, as well as insecure load violations, and possession of alcohol in a commercial motor vehicle.

Clay and Sergeant Hans Schmidt, of the CVED compliance review squad, identified Brook as being involved in three previous investigations within the last 9 months, out of service log book violations, under the influence, and in possession of alcohol and controlled substances.

Sergeant Schmidt initiated an investigation with the Federal Motor Carrier Administration (FMCA) who promptly issued a federal out of service order for Brook as a driver who is an imminent hazard.

This out of service order is one of the first of its kind and this investigation received the attention of FMCSA Administrator Anne S. Ferro as well as the U.S. Secretary of Transportation Ray LaHood.

This is an example of the Indiana State Police going beyond a typical investigation to remove unsafe drivers from the road.
