Lanane proposal enhancing outdoor event equipment guidelines approved

INDIANAPOLIS—The Indiana Senate recently approved a House bill sponsored by Senate Democratic Leader Tim Lanane (D-Anderson) to authorize the creation of new regulations for outdoor event equipment.

“In response to the devastating collapse of the Indiana State Fair stage, this legislation emphasizes the increased need for safer event equipment in order to protect our Hoosier citizens,” Sen. Lanane said. “This bill will help accomplish this goal by creating regulations for these types of situations.”

The bill is the result of an act passed last year that set up a summer study committee to research safety laws regarding stage equipment. Authored by Senator Lanane, Senate Enrolled Act (SEA) 273 created standards for stage construction and inspection, as well as a permit process. It also authorized emergency rules for stage regulation to be temporarily established by the Fire Protection and Building Safety Commission (FPBSC).

House Bill (HB) 1069 would continue this act by giving the FPBSC the ability to enact rules extending until Jan. 1, 2016 that regulate public use of outdoor event equipment for performances. The bill provides that the director of the Indiana Department of Homeland Security (DHS) can implement rules concerning emergency action or response plans for performances where outdoor event equipment is being used.

This session, Sen. Lanane also authored Senate Bill (SB) 258, which gained unanimous approval by the full Senate. SB 258 would change the wording of “outdoor stage equipment” to “outdoor event equipment,” and permanently allow the FPBSC to adopt rules regarding equipment safety.

HB 1069 recently passed out of the Senate Committee on Homeland Security, Transportation and Veterans Affairs by a vote of 6-1 and by the full Senate, 40-7. The bill will now go to the House of Representatives for final approval before moving to the governor.
