Taylor sponsors measure to strengthen child care provider standards

INDIANAPOLIS—The Indiana Senate recently passed a proposal sponsored by State Senator Greg Taylor (D-Indianapolis) to increase quality standards for owners, volunteers and employees of Indiana child care centers.

“Child care providers are a vital part of our children’s development,” Sen. Taylor said. “Confirming that child care providers are without criminal standing is a simple step we can take by passing this bill.”

House Bill (HB) 1494 requires child care license applicants, their employees and volunteers who have direct contact with the children to undergo national criminal history background checks before receiving licenses or beginning work. Currently, child care providers are required to conduct only local background checks, which may not detect some offenses, such as felonies related to the health or safety of a child, and sex offenses. Spouses and children 18 years or older of home child care providers would also have to undergo national background checks.

Employers would need to maintain records of all results and report any arrests, criminal investigations and convictions to the Family and Social Services Administration. A care provider who employs an individual convicted of crimes concerning the health or safety of a child may receive a variety of penalties, including possible loss of licensure or becoming ineligible to accept child care vouchers as a form of payment.

A child care provider who holds a license or registration on July 1, 2013 would have until July 1, 2014 to meet the new requirements under HB 1494.

This measure mirrors previous legislation authored by Sen. Taylor requiring national criminal history background checks of child care providers.

HB 1494 passed unanimously out of the Senate Committee on Public Policy and the full Senate by a vote of 42-8. The bill will now return to the House of Representatives where the author of the bill will have the opportunity to consider changes made in the Senate.
