[ISP] Commercial Motor Vehicle Driver Arrested for Carrying More Than an Overweight Steel Coil

Porter County- Today, Monday, March 24, 2014, at approximately 12:05 p.m., Commercial Vehicle Enforcement Division (CVED) Trooper Nedal Nabhan observed a 2003 Peterbilt semi pulling a covered flatbed trailer, owned by Alco Transportation Incorporated out of Wayne, Michigan, exiting from I-94 east bound at the 22 mile marker (Burns Harbor exit). The semi appeared to be overweight by its “pinched” loss of air tires.

After the semi pulled into a local truck stop on US 20 just east of I-94, Trooper Nabhan approached the semi and smelled a strong odor of alleged burnt marijuana as he spoke with the driver. The driver, later identified as Richard Leroy Goodwin, 49 of Three Oaks, Michigan, produced a valid overweight permit; however, he was in violation due to his overweight permit not being authorized to travel on I-94.

A vehicle search was conducted and less than 30 grams of a green leafy substance was located in the cab of the semi. A field test was conducted which had a positive result for marijuana. Paraphernalia was also located.

An inspection was conducted and the semi/trailer was weighed with the assistance CVED Trooper Tim Grayson. It was overweight on the trailer tandem axles by 5,800 lbs of the allowed 34,000 lbs. Goodwin was hauling a 58,130 lb steel coil.

Goodwin was arrested for Possession of Marijuana and Paraphernalia and was taken to Porter County Jail. He was also cited and placed out of service for a False Log Book, Possession of Drugs, and other violations such as overweight axles, and permit violation. The Department of Revenue was contacted and the permit was pulled.

Goodwin was coming from Portage, Indiana and was going to Flatrock, Michigan.
