Program Overview

A freestanding entity that performs abortion procedures must be licensed as an abortion clinic. Such an entity does not include a hospital that is licensed as a hospital, an ambulatory surgery center that is licensed as an ambulatory surgery center, or a physician’s office as long as the surgical procedures performed at the physician’s office are not primarily surgical abortion procedures and abortion inducing drugs are not the primarily dispensed or prescribed drug at the physician’s offices.

The ISDH monitors the health care quality of abortion clinics through the state licensure process.  Abortion clinics are licensed for one year.  ISDH surveyors visit abortion clinics at least once every two years and conduct an inspection of the facility for compliance with state rules.

Abortion Informed Consent Brochure

The ISDH was required by Indiana statute to develop an informed consent brochure and post on the department’s web site [Senate Enrolled Act 371 (2013) - IC 16-34-2-1.5].  The abortion provider is required to provide the pregnant woman with a color copy of the brochure [IC 16-34-2-1.1(a)(4)].  The ISDH Abortion Informed Consent Brochure is the statutorily required brochure.

The printer/copier version may be used to print the brochure from a desktop printer or standard copier.  The pages will print individually in numerical order.

Clinics or organizations may want to have a larger volume of brochures printed by a printing company.  The above version is intended for use by a printing company.  The version is designed to print on larger pages and then folded over and bound in the middle to form a brochure.  This version does not allow filling in of information on the back cover. 

Abortion Informed Consent Brochure (professional printer version with fillable form)

Clinics or organizations may want to have a larger volume of brochures printed by a printing company.  The above version is intended for use by a printing company.  The version is designed to print on larger pages and then folded over and bound in the middle to form a brochure.  This version differs from the above version in that it allows the provider to fill in the information on the back cover prior to printing.  The form may be saved as an Acrobat file.

The ISDH was required by Indiana statute to develop a state form documenting that the pregnant woman has received specified information [IC 16-34-2-1.1(a)(3)].  The Abortion Consent Form is the statutorily required form. 

(PDF | Word) Abortion Fetal Ultrasound and Heart Tone Certification Form

Before an abortion is performed, the abortion provider must perform a fetal ultrasound and fetal heart tone procedure.  The provider must enable the pregnant woman to view the fetal ultrasound image and hear the heartbeat of the fetus if the fetal heart tone is audible [IC 26-34-2-1.1(b)].  The purpose of this form is to document the opportunity to view the image and hear the heart tone.
