This Appellate Docket search tool (the "Appellate Docket Search Tool") is an online service provided by the Clerk of the Supreme Court, Court of Appeals, and Tax Court ("Clerk") to deliver specific appellate case information to the public.

Who May Use The Appellate Docket Search Tool?

Access to and use of this site and its contents are offered to the public, subject to the terms described herein. Any other access to or use of this site or its contents is prohibited.

Limited Right to Use

No user of the Appellate Docket Search Tool may (1) take any action that imposes an unreasonable load on the site's infrastructure; (2) in any way interfere or attempt to interfere with the proper working of the site or any activity being conducted on the site; (3) in any way attempt to decipher, decompile, disassemble or reverse-engineer any of the software comprising or making up the site; (4) delete or alter any material posted by any other person or entity; or (5) frame or link to any of the materials or information available from the site.

When retrieving information from the Appellate Docket Search Tool, you are prohibited from (1) using or attempting to use spiders, robots, avatars, intelligent agents, or any other extraction or navigation search except for a normal browser; (2) aggregating, copying or duplicating any of the materials or information available from the site except for the small amount of materials and information temporarily required for an ordinary single use of the site; or (3) accessing data not intended for your use.

You are authorized to access, use and copy information and materials available through the Appellate Docket Search Tool only as necessary for the proper use of the site's online services. The information and materials, including pages and content, may not be copied, distributed, modified, published, or transmitted in any other manner, including for use for creative work or to sell or promote other products. Violation of this policy may result in infringement of intellectual property and contractual rights of the Indiana Supreme Court, or other parties, which is prohibited by law and could result in substantial civil and criminal penalties.

Right to Change the Appellate Docket Search Tool

The Clerk may discontinue, edit, delete or change any aspect of the Appellate Docket Search Tool, including, but not limited to: (i) restricting availability times, (ii) restricting compatibility with certain computer software or hardware, (iii) restricting amounts of use permitted, and (iv) restricting, suspending or terminating any user's right to use the Appellate Docket Search Tool, at the Clerk's sole discretion and without prior notice or liability.

Who Owns This Appellate Docket Search Tool?

The Clerk is responsible for the Appellate Docket Search Tool, which, on the Clerk's behalf, is owned, developed, and maintained by the Indiana Supreme Court.

Miscellaneous

This Agreement shall be treated as though it were executed and performed in Indianapolis, Indiana, and shall be governed by and construed in accordance with the laws of the State of Indiana (without regard to conflict of law principles). Any cause of action by you with respect to the Appellate Docket Search Tool (and/or any information, products or services related thereto) must be instituted within one (1) year after the cause of action arose or be barred. The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against either party. All legal proceedings arising out of or in connection with this Agreement shall be brought solely in Marion County, Indiana. You expressly submit to the exclusive jurisdiction and venue of said courts and consent to extra-territorial service of process. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with the applicable law and the remaining portions shall remain in full force and effect. To the extent that anything in or associated with the Appellate Docket Search Tool is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Any delay or failure by the Clerk to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision. No waiver by either party of any breach or default hereunder shall be deemed a waiver of any subsequent breach or default. The titles and subtitles used in this Agreement are used for convenience only and are not to be considered in construing or interpreting this Agreement.
