for providing access to online legal research for the Indiana Trial Courts and Circuit Court Clerks

QUESTIONS & ANSWERS
 

Question 1: According to the RFP, you currently have approximately 450 judicial officers and 92 circuit court clerks. How many judicial officers and circuit court clerks currently have passwords/IDs to your current provider?

The exact number varies from month to month. JTAC has a general policy that accounts that do not get used for one (1) year are automatically terminated. With that said, we usually have around 420 individuals on our account. Going forward we anticipate a slight increase in the number of users as our judicial officers become more familiar with technology.

Question 2: Of those users with passwords/ IDS , how many actively use the service?

We think a third of the users are heavy users, a third are moderate users, and a third are light users.

Question 3: How much is JTAC paying their current provider for access to all trial court judicial officers and circuit court clerks on an annual basis? Is the annual price based on a flat fee arrangement or a per password arrangement with no guarantee?

We currently pay Lexis $27.50 per person per month with no guarantee of any specific amount of users. As a result, we pay Lexis approximately $12,000 per month.

Question 4: What is the billing arrangement for JTAC? Is it one bill?

Lexis invoices us with one bill for all the courts on a monthly basis. Entities that leverage the rate secured by JTAC are invoiced directly by Lexis with JTAC playing no role.

Question 5: What content is currently included in the courts contract?

JTAC has access to what LexisNexis' calls their "Flat Rate Library" which is a very comprehensive plan. This includes all states and Nexis.

Question 6: What is the arrangement under the current contract for content not included in the Court's current plan?

For the trial court's that access Lexis via JTAC, JTAC has opted to not allow additional access to any other databases for an additional fee. We have yet to have a court ask us for additional access. For the non-trial court entities that leverage the rate secured by JTAC, access to databases not included in the plan is decided by those entities.

Question 7: According to the PNCO, JTAC also has a favorable pricing arrangement to provide such services to other Indiana state and local government agencies. What government employees are eligible to purchase under this favorable pricing arrangement?

Any state or local government employee in Indiana . It should be noted that even some trial courts in Indiana take advantage of this. JTAC pays for the judicial officers and the circuit court clerks. The cost of additional access at the trial court level is borne by the county.

As stated in the PNCO, this is an important component to JTAC. As a result of the current contract, government employees, many of whom do business with the courts, now have access to online legal research. Moreover, to the extent JTAC can help the state ameliorate its current fiscal crisis, we will do so.

Question 8: What government employees are not eligible to purchase under this pricing arrangement?

State or local government employees not in Indiana or Federal employees.

Question 9: What content is currently included for other Indiana state and local government agencies? What is the arrangement under the current contract for content not included?

The content is the same for everyone. For our judicial officers, JTAC seeks to continue to provide comprehensive access to online legal research. With that said, some users of Lexis do not need this comprehensive access. As a result, JTAC is willing to consider submissions of two or three different access levels and pricing.

Question 10: Please provide a master list of all Indiana state and local government agencies that are currently purchasing these services via JTAC.

JTAC does not have such a list. As was stated earlier, non-trial court entities that utilize Lexis establish a relationship with Lexis independent of JTAC. We are not privy to this information. With that said, we estimate that there are 200 to 300 additional individuals leveraging the JTAC rate.

Question 11: For each participating state and local government agency, please provide: (1) the number of users (passwords/IDs) that have been provided to each participating agency and (2) the number of actual employees at each participating agency.

We do not have this information.

Question 12: It is our understanding that the current JTAC contract is an exclusive award (e.g., that JTAC agreed not to purchase services from any other provider). Does JTAC intend to make the new contract exclusive or would JTAC consider making a multiple award? Please clarify.

JTAC does not have a preference for the structure of the contract. Our goal is to provide access to our judges and others at the lowest cost possible.

Question 13: If this solicitation is for the trial courts and circuit courts only, why does Section 2 - Education and Training - ask a question regarding retraining the Indiana Supreme Court? Is it intended that the Indiana Supreme Court and Appellate Courts be covered under the new contract? Please clarify.

The purpose of this solicitation is intended to primarily be for trial courts and circuit court clerks. The PNCO is NOT intended to be for the appellate courts of Indiana . The appellate courts of Indiana have an arrangement with West that should not be impacted by this solicitation. With that said, some individuals from the appellate courts have leveraged the favorable rate secured by JTAC and now have access to Lexis.

To the extent that the use of the words "Supreme Court" was confusing, we apologize. To be clear, however, JTAC is a committee of the Supreme Court and any contract signed as a result of this solicitation will be signed by the Chief Justice of the Indiana Supreme Court.

Question 14: The PNCO states that JTAC prefers a contract that expires on June 31, 2007 "with the right to extend for additional two year periods." Does JTAC prefer that the extension be one (1) two-year period, or two (2) two-year periods? Please clarify.

We would prefer the extensions to be two year periods.

Question 15: Does JTAC have a preference on the cost structure? In other words, does JTAC prefer per person, per person based on a scale, flat rate, or variable flat rate based on access?

PNCO respondents are encouraged to think outside the box. We are open to both per person plans and flat rate plans. To the extent that we could get a financial contribution from the executive branch, we would even consider an enterprise flat rate for all Indiana government employees. The bottom line is we are trying to secure access to online legal resources at the most favorable price possible. Our primary goal is to do this for our trial court judges and our secondary goal is to do this for all Indiana government employees.

Question 16: Are print discounts provided under JTAC's current contract? If so, what discounts are offered and what are the terms of the discounts.

Yes, the language of the contract states:

"LexisNexis shall provide to the Indiana State Courts a seventy percent (70%) discount off of all retail price for any renewals or updates for any Indiana Burns printed publications or CD-Rom products currently maintained by such Courts that are published by a LexisNexis Group company (the "LexisNexis Publications"). The LexisNexis Publications discount shall only be available to the Courts that subscribe to the Online Services pursuant to the Agreement and the discount shall be effective on the date the subscription to the Online Services is effective (retroactively or prospectively) for each applicable Court."

To the extent that your proposal includes discounts on printed material, please make sure that your submission is clear on the specifics of the discount. Who is eligible? When does it apply? When does it not apply? Does it apply to existing subscriptions?
