Riparian Zones within Public Freshwater Lakes and Navigable Waters

The Commission adopted Information Bulletin #56 (First Amendment), a nonrule policy document that describes legal principles to identify riparian zones within “public freshwater lakes” under IC 14-26-2 and within “navigable” waters under IC 14-29-1.

Consolidated Proceedings with the Office of Environmental Adjudication

With the enactment of P.L. 84-2008 (codified primarily at IC 14-20-2-2.5), the Division and the Office of Environmental Adjudication recently drafted joint rules to allow for the consolidation of proceedings in disputes involving water quality or water quantity, where the Department of Natural Resources and the Indiana Department of Environmental Management may have overlapping jurisdiction. The Commission gave final adoption to rule amendments to help implement P.L. 84-2008 during a meeting held on March 17, 2009.

Annotated Procedural Rules

For the convenience of parties and their attorneys, the Division of Hearings maintains a version of its procedural rules (312 IAC 3-1) with unofficial annotations. The rules with annotations were recently updated and are accessible here.

Indiana Economic Development Corporation Rule Comments

In accordance with IC 4-22-2.1-6, comments from the Indiana Economic Development Corporation (IEDC) are made available with respect to the following rules: LSA Document #08-886, LSA Document #09-85, and LSA Document #09-137.

*These comments are also available for inspection and copying at the offices of the Natural Resources Commission, Indiana Government Center-North, 100 North Senate Avenue, Room N501, Indianapolis, Indiana. The comments were also made available at the public hearings as required by IC 4-22-2-26.

2009 Director's Annual Report

In accordance with IC 4-22-2-28.1, the 2009 Director's Annual Report, with respect to the function of the small business regulatory coordinators of the Natural Resources Commission, has been submitted to the Legislative Council and to the Indiana Economic Development Corporation.
