On March 4, 2009, the Indiana Utility Regulatory Commission (IURC) issued an order in Cause No. 43306.

All formal parties to this case - including Indiana Michigan Power (I&M), the Indiana Office of Utility Consumer Counselor (OUCC), the cities of Fort Wayne and South Bend, a group of I&M industrial customers represented by legal counsel, and the Citizens Action Coalition of Indiana - reached and signed a settlement agreement. It would allow the utility to increase residential base rates (including the introduction of 4 new rate tracking mechanisms) by approximately 6.6 percent. The utility's original proposal would have increased the same rates by approximately 20.5 percent.

Prior to this case, I&M's Indiana base rates were last increased in 1993.
