What a trademark or servicemark cannot be
Marks that are prohibited under IC 24-2-1-3 are those that
- Consist of or compromise immoral, deceptive or scandalous matter,
- Consist of or compromise matter which may disparage or falsely suggest a connection with persons, living or dead, institutions, beliefs or national symbols, or bring them into contempt or disrepute,
- Consist of or compromise the flag or coat of arms or other insignia of the United States, or of any state or municipality, or of the United Nations or any foreign nation or any simulation thereof,
- Consist of or compromise the name, signature or portrait of any living individual, except with his or her written consent,
- Consist of or compromise a ark which so resembles a mark previously registered in this state as to be likely, when applied to the goods or services of the applicant, to cause confusion or mistake to deceive, unless the consent of the previous registrant is filed with the Secretary of State.
- A mark is generally unregisterable or may need disclaimers when the mark is
- applied to goods or services of the applicant and is primarily descriptive or deceptively misdescriptive of them,
- applied to the goods or services of the applicant and is primarily geographically descriptive or deceptively misdescriptive of them, or
- primarily a surname, or
- Descriptive marks and surnames may be registered if the mark has been used by the applicant in this state or elsewhere for at least five years and the name has become distinctive of the applicant's goods or services.
