Civil Process

Service of Process by DeKalb County Sheriff

Effective July 1, 2017 Indiana Code 33-37-5-15 requires payment for Service of Process by Sheriff to be paid to the Clerk of Courts.  A $28 service or process fee shall be collected one time per case BEFORE JUDGMENT.  A $28 service of process fee shall be collected one time per case AFTER JUDGMENT.  A $60 fee shall be collected for non-Indiana cases in which service of process by Sheriff is requested.

Documents that are to be served by the Sheriff’s Civil Process Division should be mailed or hand delivered to the DeKalb County Sheriff at 215 E 8th St. Auburn IN 46706.  Payment or proof of payment for the Service of Process Fee must be included with the documents that are to be served.  A case number is required on all documents that are to be served by the DeKalb County Sheriff.  Send a self-addressed stamped envelope for return.

Payment may be made by cash, money order, cashier check, or business check and must be made payable to DeKalb County Clerk of CourtsA separate check is required for each case number.

Costs

  • $28 - On new service (one time per case)
  • $28 - On post-judgment service (one time per case)
  • $60 - On service for non-Indiana cases

Two copies of the documents to be served are required.  Mark the copy that you need served in the upper right-hand corner as SERVE and mark the copy that you need returned in the upper right-hand corner as RETURN. 

***In order to serve the papers, a PHYSICAL ADDRESS IS REQUIRED along with a valid mailing address including a Post Office Box if applicable.

Out-of-state agencies should include any Affidavit of Service required and a self-addressed stamped envelope for return.

The Service of Process Fee must be paid prior to any attempt of service.  It is the requesting party’s responsibility to show proof of payment for the Service of Process Fee per case for all documents that are to be served by the Sheriff.

IT IS THE REQUESTING PARTY’S RESPONSIBILITY TO ENSURE THE CIVIL DOCUMENTS THEY WANT SERVED ARE THE CORRECT COUNTY FOR SERVICE BASED ON THE PHYSICAL ADDRESS.

Civil documents with incorrect information, incomplete information, or Wrong County for service will be returned as “NOT FOUND IN BAILIWICK” and the Service of Process Fee will not be refunded.
