Winamac Municipal Cemetery Rules and Regulations

The Winamac Town Council shall adopt rules and regulations for the Winamac Municipal Cemetery.  The Winamac Town Clerk-Treasurer is the Cemetery Sexton and hereby enforces the rules and regulations regarding the Winamac Municipal Cemetery.  The Winamac Town Manager shall assist the Clerk-Treasurer in any capacity as requested.

SECTION I

Cemetery Area

The Winamac Municipal Cemetery is located at 414 S 50 W.  The Winamac Cemetery consists of the Winamac Cemetery, Byram T. Lane Addition, Spangler Family Additions, Moses and Amanda Dilts Addition (Crown Hill), Southlawn Addition, Poor Addition, Bridegroom Addition, New Town Addition, McKinley Memorial Gardens Addition, and McFarland Addition.

Section II

Cemetery Care, Maintenance, Monuments and Contractor Duty

Each lot or part thereof in the Winamac Municipal Cemetery shall be, and hereby is, subject to the following conditions and limitations with the privileges specified as follows:

  1. The term “monument” as used herein shall be deemed to mean any head or grave identification of bronze, granite, marble, stone and the like.  Any other man-made object placed on a grave or lot shall be construed as a marker.
  2. Before any monument/foundations (footings) are constructed and/or markers placed. The contractor constructing the monument/foundation (footings) or placing the marker shall first submit a foundation application permit to be approved by the cemetery sexton.
  3. No markers, concrete aprons, flowers vases, footings, or planting of any nature whatsoever shall be set or installed until the approval of the cemetery sexton has been given consistent with the terms hereof.
  4. All monument/foundations shall be constructed of concrete and shall extend a minimum of thirty-six inches (36”) below grade, shall extend the width of the grave space and twenty- four inches (24’’) front to back.  All four sides shall be straight and vertical, all aprons shall be flush with the ground and 2 feet front to back.  No foundation shall be poured until inspection has been approved by the Town of Winamac. Failure to have inspected may result in footer being removed.
  5. All monuments shall be placed at the head end of the grave. Small bronze VA plaques and VA medallions may be mounted on the headstone.
  6. The Town of Winamac Columbarium located in McFarland edition will only have openings and closings performed by a representative from Patton Monuments
  7. There shall be no above ground monument placed in the McKinley Addition Garden of Devotion and Garden of Memories.  Only flat grave markers are to be placed level with the ground.
  8. Not more than one monument shall be permitted on any one grave.  Such monument shall be erected only upon a concrete footing.  A double monument shall be permitted when centered upon two graves for a couple buried within.
  9. All artificial flower arrangements must either be mounted to the monument or marker, or must be in metal or concrete containers.  The cemetery will be cleared of flowers and ornamentations twice a year.  Said dates for removal shall be the Thursday before Good Friday and the Friday before Columbus Day. The said dates will be advertised for two weeks prior to cleaning in the local newspaper and is listed on the Town of Winamac web site www.townofwinamac.com.  The Town of Winamac (“town”), Winamac Town Council, Clerk-Treasurer, and those associated with the care and maintenance of the cemetery are not liable for any loss or destruction of flowers, vases, grave markers, or monuments, etc. because of vandalism or an act of God. All vandalism shall be reported to the Winamac Police Department.  Vandals of cemetery property may be prosecuted.
  10. Ornaments which constitute nuisances to the proper maintenance of the cemetery grounds may be removed by authorized personnel of the cemetery.  Such ornaments include, but are not limited to: plastic animals, plastic fences, plastic flowers, plastic lawn ornaments, wire baskets and urns, glass ornaments or containers, or any such materials that could cause personal injury or damage if thrown from mowing equipment.
  11. No live plants, bushes, shrubs, trees, etc. shall be planted in the cemetery nor shall any landscaping be performed around the grave unless approved by the Cemetery Sexton.  Cemetery personnel shall have the right to remove any such plantings that are deemed in violation, or any shrubs that are left to grow rampant.
  12. The funeral home in charge of arrangements shall mark the grave with a temporary marker.
  13. The Town shall be responsible for the care and maintenance of the cemetery. All mowing, landscaping, grading of lots, driveway care, snow removal, etc. shall be done under the direction of the Clerk-Treasurer and Town Manager.
  14. The grantee, their heirs, successors, and assigns are herby given a perpetual right to the free use of the passageways of the entire cemetery together with the right to use the other facilities that are now or may hereafter be erected in said cemetery for use by owners of burial rights within the cemetery or the general public, provided that any user thereof shall do so as to not interfere with the rights of other owners of burial rights therein and consistent with the rules and regulations now or hereafter adopted respecting the maintenance, operation and control of said cemetery.
  15. No one under the age of 18 shall be allowed in the cemetery from 7:00 P.M. - 7:00 A.M. unless accompanied by an adult.
  16. Funeral processions shall have priority over any activities while on cemetery grounds.  In the event of a funeral, drives must be kept clear and unobstructed for the procession.  When informed by town officials to move vehicles, please do so immediately to an area that will not interfere with the funeral procession.
  17. There shall be no parking or driving of unauthorized vehicles on cemetery grounds except on gravel/blacktop lanes as provided. Visitors to the cemetery shall respectfully keep their vehicles on provided lanes at all times.
  18. The Winamac Town Clerk-Treasurer (cemetery sexton) shall designate who is allowed to dig graves in Winamac Cemetery, No Digging is allowed on cemetery property without the expressed permission and signed application of the Clerk-Treasurer
  19. When any work is being completed in the Winamac cemetery by contractor’s respect of citizens and visitors shall be held to a high standard. Professional appearance and conduct shall be always expected.
  20. A copy of the contractor certificate of liability insurance shall be provided to the Town Manager once per year, before any work can be completed.

Section III

Pauper Section and Indigent Burial Policy

  1. It shall be the policy of the Winamac Municipal Cemetery to furnish without a charge a grave site for a deceased indigent person who was a resident of Winamac at the time of death or a former resident who was residing in a health care facility at the time of death. Please consult the Cemetery Sexton for any questions.
  2. The Clerk-Treasurer has designated specific areas within the cemetery for pauper graves. No monument shall be erected and no improvements shall be made on any cemetery space that has not been paid in full.
  3. If the heirs of a recipient of a pauper grave decide that they want to place a stone, the space must first be paid for and then only a flat marker that is flush with the ground will be permitted.

Section IV

Burial of Human Remains and Burial of Cremated Remains

  1. Prior to any burial, the Funeral Home in charge of arrangements shall secure form the Health Department, an Indiana Burial Transit Permit.  Permission for burial may be reasonably withheld by the Clerk-Treasurer pending compliance with cemetery rules and regulations as well as compliance with state and local laws.
  2. The cemetery copy (yellow) of the Indiana Burial Transit Permit shall be completed by the Funeral Home in charge of arrangements and sent to the Clerk-Treasurer as soon as possible.  When burying cremated remains, a new burial permit indicating the cemetery as place of disposition (not the crematory) is to be completed.  All out of state burials must be accompanied by a completed Indiana Burial Transit Permit.
  3. Permission for all burials shall be secured by the Funeral Home in charge of arrangements, by completing a burial request form from the Clerk-Treasurer prior to the planning of any ceremony or services at the cemetery.  Absolutely no ceremony or services for burial will be performed at the cemetery without a Licensed Indiana Funeral Director present: prior approval of the Clerk-Treasurer
  4. Burial Vaults and Urn Vaults constructed of concrete are required for all burials.
  5. Burial is restricted to one burial vault per grave or two urn vaults per grave.
  6. Columbarium is restricted to one entombment per niche.
  7. Scattering of Cremated Remains on cemetery property will not be permitted.  NO EXCEPTIONS.
  8. Above ground interments shall only be permitted for a monument specifically designed to hold cremated remains.  All other above ground burials shall not be permitted until such time as the Town provides a mausoleum and/or columbarium.
  9. Burial of any animals shall not be allowed in the Winamac Cemetery, except as provided by Indiana law.

Section V

Removal of Human Remains (Disinterment) and Removal of Cremated Remains (Disinurnment)

  1. 1)Removal of Human Remains or Cremated Remains form the cemetery will be only in accordance with Indiana Law and must be performed under the direct supervision of a Licensed Funeral Director.  The Funeral Home in charge of arrangements must secure permission from the Clerk-Treasurer.  All permits must be properly filed by the Funeral Home on charge of arrangements prior to disinterment or disinurnment.
  2. It shall be the established policy of the Town that anyone wishing to have the remains of a relative disinterred and reinterred at another location in the Winamac Cemetery or elsewhere, shall contract with a private firm having the proper equipment and experience to perform this service.  All applicable Indiana Laws will be followed.  The Funeral Home providing this service shall notify the Clerk-Treasurer of their intention of moving the remains and provide all legal and necessary documentation to perform this service.  All services relating to disinterment and/or reinterment shall be under the direct supervision of a Licensed Indiana Funeral Director and the Clerk-Treasurer or an assignee.  The firm providing the service shall restore all areas of the cemetery disturbed back to its original condition under the supervision of the Clerk-Treasurer or an assignee of the Clerk-Treasurer.

Section VI

Sale of Cemetery Burial Rights

  1. Any person purchasing burial rights in the Winamac Cemetery shall be given a certificate of burial rights executed on behalf of the Town of Winamac.  The Clerk-Treasurer shall collect from the purchaser of burial rights the current document recording fees as set forth by the Pulaski County Recorder and shall record said certificate with the Pulaski County Recorder’s Office.
  2. A copy of the Winamac Cemetery Rules and Regulations shall be provided the purchaser at the time of sale of burial rights.  The owner of burial rights is responsible for complying with the cemetery rules.
  1. It shall be understood and agreed that the conditions, limitations, and provisions as set forth in these Rules and Regulations constitute a covenant running with the land and shall be binding upon each direct or subsequent purchaser by the within procedure and a breach by such purchasers or grantees shall entitle the Town of Winamac to the possession of said burial rights herein conveyed and it is hereby expressly agreed that as a part of the consideration for the above purchase of said burial rights in said cemetery shall be sold and transferred under the same provisions and conditions as herein set out.  Any transfer thereof, by way of inheritance, succession, or sale shall be reported to the Town Clerk-Treasurer.
