Town of Farmersburg ADA Grievance-Request Procedure

In accordance with the Americans with Disabilities Act of 1990 (ADA)

A. This Grievance Procedure may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the Town of Farmersburg, Indiana. The Town’s Personnel Policy governs employment-related complaints of disability discrimination.

B. The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request. The complaint should be submitted by the grievant and/or his/her designee as soon as possible but no later than 60 calendar days after the alleged violation to the Town’s ADA Coordinator, with a mailing address as follows.

C. Within 15 calendar days after receipt of the complaint, the ADA Coordinator will meet with the complainant to discuss the complaint and the possible resolutions. Within 15 calendar days of the meeting, the ADA Coordinator will respond in writing, and where appropriate, in a format accessible to the complainant, such as large print, Braille, or audio tape. The response will explain the position of the Town and offer options for substantive resolution of the complaint. If the response by the ADA Coordinator does not satisfactorily resolve the issue, the complainant may appeal the decision within 15 calendar days after receipt of the response to the ADA Coordinator.

D. Within 15 calendar days after receipt of the appeal, the ADA Coordinator will meet with the complainant to discuss the complaint and possible resolutions. Within 15 calendar days after the meeting, the ADA Coordinator will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint.

E. All written complaints received by the ADA Coordinator, appeals to the ADA Coordinator, and responses from this office will be retained by the Town for at least three years.

When the ADA Grievance-Request Form is available on the Town of Farmersburg website, it may be downloaded and printed. Otherwise, forms are available at Town Hall. You may also call or visit, or submit a message through the Town’s website when available, requesting assistance in filling out a Grievance-Request Form, and an appropriate person with the Town will respond and assist you.

The Town of Farmersburg acknowledges its responsibility to comply with the ADA. In order to assist individuals with disabilities requiring special services (sign interpretative services, alternative audio/visual devices, etc.) for participation in or access to town-sponsored public activities (e.g., programs, services, meetings), the Town asks requests for these services be made to ADA Coordinator at least forty-eight (48) hours ahead of the scheduled activity.
