Juvenile Probation

The Mission of the Juvenile Probation Department is to Assess, Represent and Monitor justice for delinquent youth, their families, and the community.  We are an A.R.M. of the Juvenile Court. This mission is accomplished by utilizing evidenced based assessment tools to measure the risk and needs of youth; conducting thorough Preliminary Inquiries; collaborating with youth, families, schools, and other providers, and making recommendations to the Juvenile Court that balances the risk and needs of the youth with the needs of the community.

The Probation Department recognizes the value and potential that the youth in our community possess and works to help youth take responsibility for their decisions; overcome barriers and grow to become productive young men and women.

The Probation Department, as an extension of the Court, has been involved in the Juvenile Detention Alternatives Initiative since 2014.

  • Community Collaboration and Resources

    Youth and families are encouraged to seek out support within their community before turning to the justice system when possible.  Although the Probation Department does not specifically endorse a particular program, below are several resources available for youth and families to consider:

  • Expungement

    AUTOMATIC EXPUNGEMENT:

    As of July 1, 2021, Indiana law permits the automatic expungement of certain records related to juvenile adjudications.

    Automatic expungement applies to all juvenile adjudications after June 30, 2021 except:

    • a felony, if the act had been committed by an adult;
    • handgun violations;
    • children and firearms violations; or
    • when the Court exercises its discretion to override automatic expungement based on
    • the nature of the delinquent act; and
    • the needs of the juvenile.

    Automatic expungement occurs:

    • when the child reaches nineteen (19) years of age; or
    • one (1) year after the date on which the Court discharged the child and his/her parents, guardian, or custodian – whichever is later.

    MANUAL EXPUNGEMENT:

    If your child is not eligible for automatic expungement, he/she may apply in writing to manually expunge his/her juvenile record, in accordance with Indiana Code 31-39-8-3.  The person requesting expungement must complete and return the Verified Petition for Expungement and a copy of their photo ID to the probation department for filing. Once filed, the Prosecuting Attorney has thirty (30) days to file an Objection to Expungement before the Juvenile Court will review the Verified Petition.  When considering the request, the Juvenile Court will at least consider the following:

    • The number of and types of adjudications in the juvenile record
    • The level of compliance with probation supervision and court requirements
    • Any arrests or charges filed since the Juvenile Court’s jurisdiction ended
    • Why the petitioner is requesting expungement
    • Employment and education status

    If an objection is filed by the Prosecuting Attorney, a hearing will be scheduled.   If the Court denies the Verified Petition for Expungement, the Petitioner will be notified and may request a hearing.

  • Advice of Rights (Indiana Code 31-37-8-4)

    When a Preliminary Inquiry is conducted, the intake officer shall advise the child and the child’s parent, guardian, or custodian of the following: (1) The nature of the allegations against the child. (2) That the intake officer is conducting a preliminary inquiry to assist the prosecuting attorney in determining whether a petition should be filed alleging that the child is a delinquent child. (3) That the intake officer will recommend whether to: (A) file a petition; (B) file a petition and recommend that the child be referred for an assessment by a dual status assessment team as described in IC 31-41; (C) informally adjust the case; (D) informally adjust the case and recommend that the child be referred for an assessment by the dual status assessment team as described in IC 31-41-1-5 ; (E) refer the child to another agency;  or (F) dismiss the case. (4) That the child has a right to remain silent. (5) That anything the child says may be used against the child in subsequent judicial proceedings. (6) That the child has a right to consult with an attorney before the child talks with the intake officer. (7) That the child has a right to stop at any time and consult with an attorney. (8) That the child has a right to stop talking with the intake officer at any time. (9) That if the child cannot afford an attorney, the court will appoint an attorney for the child.

  • Payment of Fees

    The Juvenile Probation Department collects payments for: Administration Probation Fees, Initial and Monthly Probation Fees, Restitution, Drug Screens and Electronic Monitoring.

  • Fees and Restitution

    The Juvenile Court assesses various fees against the youth and/or parent/guardian.  The Probation Department makes recommendations for fee assessments as follows:

    • Administrative Fee – $100.00
    • Court Costs:  $171.00
    • Drug Screen Fee – $8.00-$25.00
    • Initial Probation User Fee – $50.00-$100.00
    • Monthly Probation User Fee: $5.00-$25.00 per month
    • Restitution – Amount ordered at the time of hearing
  • Duties of a Probation Officer (Indiana Code 31-31-5-4)

    A probation officer shall, for the purpose of carrying out the juvenile law: (1) conduct such investigations and prepare such reports and recommendations as the court directs and keep a written record of those investigations, reports, and recommendations; (2) receive and examine complaints and allegations concerning matters covered by the juvenile law and make preliminary inquiries and investigations; (3) implement informal adjustments; (4) prepare and submit the predisposition report required for a dispositional hearing under the juvenile law; (5) supervise and assist by all suitable methods a child placed on probation or in the probation officer's care by order of the court or other legal authority; (6) keep complete records of the probation officer's work and comply with any order of the court concerning the collection, protection, and distribution of any money or other property coming into the probation officer's hands; and (7) perform such other functions as are designated by the juvenile law or by the court in accordance with the juvenile law.
