The purpose of FED-02 (state form 51905) is to provide the information needed to complete a preconstruction review for a new or reconstructed process or emissions unit that is subject to any of the Maximum Achievable Control Technology (MACT) standards contained in 40 CFR Part 63, National Emission Standards for Hazardous Air Pollutants (NESHAP). FED-02 is a required form and shall be submitted to IDEM, OAQ whenever MACT preconstruction approval is required. MACT preconstruction approval under 40 CFR 63.5 is only required when the proposed new or reconstructed affected source in and of itself has the potential to emit greater than 10 tons per year of a single hazardous air pollutant (HAP) or greater than 25 tons per year of a combination of HAPs.

Submission of Confidential Records
All information submitted to IDEM will be made available to the public unless it is submitted under a claim of confidentiality. Claim of confidentiality must be made at the time the information is submitted to IDEM, and must follow the requirements set out in 326 IAC 17.1-4-1 [PDF]. Failure to follow these requirements exactly will result in your confidential information becoming a public record, available for public inspection. Part A: General Information
Part A identifies the applicable MACT standard and affected source, and to determine whether Section 63.5 of the Part 63 General Provisions is applicable to the affected source.
NOTE: An "affected source" is defined in 40 CFR 63.2 of the General Provisions as the stationary source, the group of stationary sources, or the portion of a stationary source that is regulated by a relevant standard or other requirement established pursuant to Section 112 of the Clean Air Act. Typically, each MACT standard defines the applicability of the affected source within the first few regulatory sections of the final rule. A list of all the Part 63 NESHAPs (MACT standards) are available on the U.S. EPA Web site.
- Identification of the Applicable MACT Standard: Identify the applicable MACT standard by the subpart letter designation and the source category name.
- Affected Source(s): Identify all processes that comprise the affected source for the applicable MACT standard.
- Will the proposed construction be a major source of HAP emissions? If the potential to emit hazardous air pollutants (HAP) from the proposed construction is greater than or equal to ten (10) tons per year of any single HAP or twenty-five (25) tons per year from combined HAP, the new or reconstructed affected source is major for HAP.
Note: Indiana Law requires permit emission limits to be based on the potential to emit (PTE) air pollutants as if the process was operating at full capacity 24 hours per day, seven (7) days per week.
Part B: Emissions Unit Information
Part B identifies those emissions units that are part of the affected source and will be constructed or reconstructed:
- Unit ID: Provide the identification number for each emissions unit. The identification numbers listed on this form should correspond to the emissions unit identified on the Plant Layout and Process Flow diagrams.
- HAP Name: Identify each category, or type, of HAP released to the atmosphere during operation of this emissions unit.
- Quantity of HAP Emitted: Provide the quantity of each type of HAP released to the atmosphere during operation of this emissions unit, and specify the units used to measure the quantity of HAP emitted.
- Actual Emissions: Provide the actual emissions level based on normal operating conditions (i.e., actual hours of operation, using control equipment, etc.). Since the units will vary depending on the process, appropriate units must be included or the application process may be stopped.
- Potential to Emit: Provide the total potential to emit in tons per year (tpy) based on the maximum design capacity of the emissions unit and operating at 8760 hours/year.
Part C: Compliance Methods for New Affected Sources
Part C identifies the compliance method chosen for each new affected source.
- Unit ID: Provide the identification number for each new emissions unit. The identification numbers listed on this form should correspond to the emissions unit identified on the Plant Layout [PDF] and Process Flow [PDF] diagrams.
- Compliance Method Description: For each emissions unit, identify the method or methods chosen to comply with the applicable MACT standard.
- Control Efficiency: For each emissions unit, provide the control efficiency of the chosen compliance method.
Part D: Compliance Methods for Reconstructed Affected Sources
Part D identifies the compliance method chosen for each reconstructed affected source.
- Unit ID: Provide the identification number for each reconstructed emissions unit. The identification numbers listed on this form should correspond to the emissions unit identified on the Plant Layout and Process Flow diagrams.
- Description of Current Compliance Method Description: For each emissions unit, identify the method or methods currently used to comply with the applicable MACT standard.
- Description of Proposed Compliance Method Description: For each emissions unit, identify the method or methods that you are proposing to use to comply with the applicable MACT standard.
- Control Efficiency: For each emissions unit, provide the control efficiency of the chosen compliance method.
